Taste of the City, Sounds of the Ironbound Passport Giveaway Rules and Regulations

  1. Eligibility:
  • The giveaway is open to legal residents of the United States who are 21 years of age or older at the time of entry.
  • Employees, officers, and directors of Plusable PR Agency, Greater Newark Convention and Visitors’ Bureau (GNCVB), United Airlines, and their respective subsidiaries, affiliates, and advertising and promotion agencies, as well as the immediate family members and/or those living in the same household of each, are not eligible to participate.
  1. How to Enter:
  • Participants must pick up a Passport at any of the participating venues during the North 2 Shore festival in Newark on June 30th.
  • Participants must visit all nine participating venues, and collect a custom label from each location.
  • Once all nine labels are collected, participants must submit their completed Passport at the designated locked box drop-off location by 10 PM on June 30th. Each venue will have a drop off locked box onsite.
  1. Prize:
  • One (1) grand prize winner will receive a trip for two (2) (winner and one (1) guest age 21 or older) to Porto, Portugal, including:
    • Round-trip business class airfare courtesy of United Airlines.
    • Four (4) nights hotel stay in Porto.
  • Travel dates shall be solely determined and designated by the Sponsor. The trip must be taken during the low season (spring or autumn), subject to availability and blackout dates.
  • The grand prize trip for two has a maximum retail value not to exceed $15,000, and includes:
    • Round trip business class airfare for two (winner and one guest age 21 or older) from the nearest major airport to the winner’s home as designated by Sponsor to the Sponsor designated airport servicing Porto, Portugal.
      • Actual departure date, times, and airline based upon availability and will be solely determined by Sponsor;
    • Four (4)-nights standard hotel accommodation (one room, double occupancy) at a standard hotel as solely designated by Sponsor in Porto, Portugal (based upon availability);
      • Arrival and departure dates as solely specified by Sponsor, based upon availability;
  • The prize is non-transferable and cannot be exchanged for cash or any other items.
  • Decisions of the Sponsor and Sweepstakes Administrator in the selection and determination of the grand prize winner, and all matters relating to this Sweepstakes are final and binding.
  1. Drawing and Notification:
  • The winner will be selected in a random drawing from all eligible entries received.
  • The drawing will be held on Monday, July 15th at the Greater Newark Convention and Visitor’s Center (58 Park Place, Newark).
  • The drawing will be live-streamed on the @newarkhappening Instagram platform.
  • The winner will be notified via phone and/or email within 48 hours of the drawing.
  • If the winner cannot be contacted or does not respond within seven (7) days of the initial notification, an alternate winner may be selected.
  1. Prize Conditions:
  • Winner and guest must have valid Passports in order to travel, with expiration dates a minimum of 6-months following the scheduled return date. If the winner or guest fails to produce valid Passports at the time of departure, they shall forfeit the prize award, and shall not receive any alternate prize award or compensation.
  • All ground transportation, airport/hotel transfers, parking, meals, gratuities, checked baggage fees, airline seat assignment fees, hotel resort fees, travel or departure taxes, incidental expenses, applicable taxes (including, but not limited to all local, state, and federal taxes) and any other expenses not specified herein as being included in the prize award are the sole responsibility of the winner.
  • Winner and guest shall be subject to any qualifying conditions prior to and during travel, including any local government regulations in the departure or destination location, airline and/or hotel requirements, or any regulation related to COVID-19 testing requirements, vaccination status, or policy. Any testing requirements, vaccination, and/or any related quarantine requirements and expenses are the sole responsibility of, and at the sole expense of winner and guest.
  • Travel dates are based upon availability, and as solely determined and designated by Sponsor, and must be completed by date determined by United Airlines, or prize award may be forfeit. Sponsor is not responsible for any travel delays, flight delays or cancellations, or travel difficulty related to prize award, redemption, or use. If travel delays or difficulty prevent arrival in time for any and all elements of such prize award, Sponsor is not responsible for awarding any compensation in lieu thereof. Sponsor is not responsible for late, lost, damaged, or stolen luggage.
  • The winner and his/her guest must travel together on the same itinerary. Any changes to completed travel arrangements, once booked, are the sole responsibility of the winner, and are solely at the winner’s expense. Actual value of the trip will depend on point of departure, and any airfare fluctuations. If the actual value of the prize is lower than the stated ARV of the prize award when it is procured and fulfilled, then the difference will NOT be awarded to the winner. The winner and travel companion are solely responsible for all costs incurred to and from the nearest major airport to the winner’s home as designated by Sponsor as the prize originates and terminates at such departure point unless otherwise agreed to by Sponsor in writing.
  • Grand prize winner and guest must be of legal age of majority in his/her state of residence (and at least 21) and will be required to execute and return a liability/publicity release prior to prize award. It is recommended that winner and travel companion obtain sufficient personal insurance prior to departure. Winner and travel companion hereby release Sponsor from any duty to provide, check, or verify any and all necessary ID’s, passports, visas and tourist cards, birth certificates, vaccination certificates, and any other travel requirements (“Personal Documents”). Sponsor shall not have any responsibility for the replacement of lost or stolen Personal Documents or tickets, coupons, vouchers, receipts or other documents pertaining to the prize (“Travel Documents”) once the Travel Documents have been provided to winner and travel companion.
  • Sponsor will not be responsible for any travel delay, rescheduling, postponement, or cancellation for any reason including but not limited to weather, pandemic, an Act of God, Force Majeure, government regulation or restriction, an act of terrorism, civil disturbance, work stoppage, or any other reason. No substitute prize award or compensation shall be provided by Sponsor in the event of any travel delay, rescheduling, postponement, or cancellation for any reason, and the winner shall be subject to the terms and conditions of the airline ticket and hotel policy, and shall solely look to the airline ticket and hotel provider.
  • Winners and guests agree to comply with all applicable airline and hotel provider rules, requirements, and regulations in connection with the prize award, redemption, and use. Sponsor and travel provider reserve the right to remove or deny entry to any winner and/or his/her guest who do not comply with any rule, requirement, instruction, policy, or who engage in a disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. Winner and guests shall be solely responsible for their behavior while traveling, must follow the instructions and direction from any travel provider or associated staff or security. If the winner or any guest violates the standards of the travel provider, behaves in an inappropriate, irresponsible, or offensive manner, or is deemed by staff or security to have violated any rule, regulation, or policy of the travel provider, or to be a security threat in any manner, the winner and guest shall be ejected or denied travel arrangements, and shall immediately forfeit the remaining prize award.
  • In the event travel arrangements are unable to be booked due to a Force Majeure Event, Sponsor reserves the right, in its sole discretion, to extend the deadline for travel beyond its stipulation, or to award the winner an alternate prize award of approximate equal value, in lieu of the trip and such alternate prize shall be the full and final Grand Prize award.
  1. General Prize Conditions:
  • No alcoholic beverage is part of any prize award. All other costs and expenses related to prize acceptance, redemption, and use not specified herein as being provided are the sole responsibility of the winner, including but not limited to delivery charges, or any incidental expenses. All income, federal, state, and local taxes are the winner’s sole responsibility. All prize awards are non-transferable and no cash redemption or prize substitution allowed, except at Sponsor’s sole discretion or as provided herein. Sponsor reserves the right to substitute a prize with one of comparable or greater value, at its sole discretion. All prizes are awarded as is, without any warranty, express or implied, by Sponsor. Failure to collect or properly claim the prize in accordance with these rules will result in forfeiture of the prize. If forfeited for any reason, the participant will not receive any other prize substitution or compensation, and the prize will remain the property of Sponsor and will not be awarded, except as provided herein. All properly claimed prizes will be awarded. Any unclaimed prizes will not be awarded.
  1. Additional Rules & Restrictions:
  • By participating, entrants agree to abide by and be bound by the Official Rules and the decisions of the Sponsor and Administrator, which shall be final in all matters relating to this Sweepstakes. In the event an entrant wins a prize, and is later found to be in violation of these rules he/she will be required to forfeit the prize or to reimburse Sponsor for the stated value of the prize if such violation is discovered after the winner has used the prize. Participation in Sweepstakes constitutes permission for the Sponsor and its designees to use entrants’ names, cities and states of residence, and/or likenesses for purposes of advertising and trade in any and all media now or hereafter known worldwide on perpetuity without limitation or further compensation, notification, or permission, unless prohibited by law. False, fraudulent, or deceptive entries or acts, including submission of any false information, shall render entrants ineligible for any prize.
  • By participating, entrants agree to hold all Released Parties harmless from any claims, losses, actions, or damages of any kind, whether actual, incidental, or consequential, for injury (including but not limited to death), damages, losses, or expenses arising out of or relating to entrant’s participation in this Sweepstakes, or the acceptance, possession, or use/misuse of any prize, or participation in prize-related activities (including but not limited to travel or activity related thereto), and to assume all liability therefor.
  • Released Parties shall not be liable to the winner or any other person for failure to supply the prize or any part thereof by reason of any acts of God, pandemics, any actions, regulations, orders, or requests by any governmental entity, equipment failure, terrorist acts, war, fire, unusually severe weather, embargo, labor dispute or strike, labor or material shortage, transportation interruption of any kind, or any other cause beyond Released Parties’ sole control.
  • Sponsor reserves the right to cancel, modify or terminate the Sweepstakes for reasons including, but not limited to fraud, misconduct, regulatory requirements, acts of God, pandemics, or if any technical issues, programming errors, or failures destroy or threaten the integrity of the Sweepstakes, in the opinion of the Sponsor/Administrator, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Sweepstakes as determined by Sponsor/Administrator, in their sole discretion. In the event of early termination of the Sweepstakes, Sponsor reserves the right to determine prize winner(s) in a random drawing from among all eligible, non-suspect entries received as of the time/date of such termination.8. Notification of Potential Winners:
  • The potential grand prize winner will be notified initially by phone and/or email following his/her selection. If the Sweepstakes Administrator is unsuccessful in its attempt to reach and speak directly with the selected potential prize winner by phone within 48 hours of the initial attempt to the phone number associated with his/her entry, then that contestant may be disqualified and an alternate potential prize or first prize winner may be randomly selected from among the remaining eligible entries and notified as per the procedures outlined above (time permitting).
  • Messages will not be left for any selected potential grand prize winner in the phone call notification process.
  • During winner notification, the selected potential winner must confirm their eligibility, and indicate their willingness to accept the associated prize award (see below), as designated by Sweepstakes Administrator. The potential winner will then receive official notification via email and will be required to complete and return within 3-days of receipt of prize acceptance document including affidavit of eligibility and liability/publicity release form.
  • If the selected potential prize winner does not meet the eligibility requirements or elects to decline the prize, or does not return the required prize claim form within the required deadline, s/he will be disqualified and, at Sponsor’s discretion and time permitting, an alternate winner will be randomly selected from among all remaining eligible entries and notified as per the procedures outlined above. Any disqualified contestant will not receive any alternate prize substitution or compensation.
  • All of the following will apply to the potential grand prize winner:
    1. Winner will be required to complete and return, within 3-days of date of receipt, a prize acceptance form, including an affidavit of eligibility and a liability/publicity release (where permitted); and a W-9 form.
    2. Winner may be required to present a copy of a valid driver’s license or government-issued photo ID with valid residential address as a condition of participating or receiving any prize.
    3. Grand prize winner shall be issued a 1099 form reflecting the value of the prize award and shall be solely responsible for paying all applicable taxes (including, but not limited to, all local, state, and federal taxes) that may be or become due in connection with their respective prize award.
  • 9. In Case of Disputes:
  • By participating, each entrant agrees that:
    1. Any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of New Jersey.
    2. Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, and in no event will entrant be entitled to receive attorneys’ fees or other legal costs.
    3. Under no circumstances will the entrant be permitted to obtain awards for, and the entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
    4. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with this Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of New Jersey or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of New Jersey.
  • 10. Odds:
  • Odds of winning the grand prize award are dependent upon the total number of eligible entries received.
  • 11. Release of Liability:
  • By entering, participants release and hold harmless Plusable PR Agency, United Airlines, their respective affiliates, subsidiaries, advertising and promotion agencies, and all others associated with the development and execution of this giveaway, from any and all liability for any injuries, losses, or damages of any kind arising from or in connection with the giveaway or acceptance or use of any prize won.
  • 12. Privacy:
  • Any personal information collected in connection with the giveaway will be used solely for the purposes of administering the giveaway and will not be shared with third parties, except as necessary for the administration of the giveaway or as required by law.
  • 13. Official Rules & Winners List:
